We, BigTac Sdn Bhd (Registration No.: 202201032407 (1478104-A)) (hereinafter referred to as “BigTac”, “we”, “us”, “our” and other similar expressions) take, with value, respect and utmost importance that the privacy rights of all our customers across the aspects of our business and we serve to protect your Personal Data (as hereinafter defined) to be in compliance with the laws of Malaysia.

This written notice (“Notice”) shall set out the basis of where BigTac shall only collect and use your Personal Data in accordance with the Personal Data Protection Act 2010 (“PDPA”), and any other legislations, regulations and guidelines which shall be in relation thereto, with this Notice and such other term(s) in the agreement(s) that you may contract with us or have contracted with us.

This Notice shall also apply to any and all Personal Data under our control, which includes among others, the Personal Data in possession of organisations which we have engaged to collect, use, disclose or process such Personal Data for our purposes. Please kindly note that unless explicitly mentioned as otherwise, the words used herein shall carry the same meaning and definition as per the PDPA.

We highly encourage you to carefully read this Notice on our efforts to protect your Personal Data. In order to understand the process of collection, usage, handling, retention and disclosure of your Personal Data, this Notice sets out the following:

1. Personal Data We Collect From You

1.1. In order for us to provide you with our services, deal with any of your queries, requests, applications, open and operate an account with us, we are required to collect and use your Personal Data. Personal Data are either obligatory or optional, so we will indicate at the time of request on whether any Personal Data is obligatory and in the event you decline to provide obligatory Personal Data or withdraw your consent to use using such Personal Data, our ability to provide you access to some of our services may be affected.

• 1.2.1. Name;
• 1.2.2. Email address;
• 1.2.3. Mobile number;
• 1.2.4. Motor vehicle registration number
• 1.2.5. Photos of you and your vehicle within the relevant parking premises;
• 1.2.6. Payment information; and
• 1.2.7. Any other relevant information which may enable us to provide you with our services, all of the abovementioned hereinafter shall be referred to as “Personal Data”.

1.3. We do not collect any of your Personal Data unless such data has been voluntarily given by you either directly or via a third-party who has been duly authorised by you to disclose your Personal Data to us where you or any one of your authorised representatives:

• 1.3.1. have been notified of the purposes for which the data is collected and have provided written consent to the collection and usage of your Personal Data for those purposes; or
• 1.3.2. the collection of your Personal Data is required by laws of Malaysia.

1.4. Any and all collection of any additional Personal Data shall be notified by you and we shall seek your consent prior to any collection and usage for a purpose of the same which has not been notified to you at the initial stage, provided that such collection shall be permitted and / authorised by law.

2. Sources of Personal Data

2.1. We will collect your Personal Data when you use our parking services on the website; when you provide your details when sending us queries and sending us requests for refund; via e-mails, short messaging service (or any other analogous form of messaging) and social media channels; when we enter into any contract with you; when you enter any parking premises where our services are available and when you participate in any of our programmes or events.

2.2. We may also collect your Personal Data from:

• 2.2.1. third party related application(s) or software(s) for the purpose of providing you with our services or any related services;
• 2.2.2. individuals connected to you such as your family members, friends, colleagues;
• 2.2.3. our business partners;
• 2.2.4. any third-party that you have authorised to disclose your Personal Data to us.

3. Purposes of Processing Your Personal Data

3.1. We may collect your Personal Data for, but not limited to, the following purposes:

• 3.1.1. to identify users of our service, potential users and their representatives;
• 3.1.2. to provide our services and any related services thereto;
• 3.1.3. Processing any payment and / or credit transaction in relation to the services provided herein;
• 3.1.4. to manage and maintain your account with us;
• 3.1.5. for administration purpose(s);
• 3.1.6. to develop and/or implement initiatives to improve our services;

3.2. As for your Personal Data storage, we will only allow limited personnels to have limited access to your Personal Data. Rest assured, our personnels shall be at all times in compliant to the confidentiality of any and all of your Personal Data held by us.

4. Disclosure of Your Personal Data

4.1. We may disclose your Personal Data where such disclosure is for the performance of our services requested by you or to any of the third-party service providers, agents and other organisation in which we have engaged to provide our services to you.

• 4.2.5. where such disclosure is required or authorised by law or by the order of a Court.

5.1. Your Personal Data shall be protected by us via strict standards of security and confidentiality to ensure the security, integrity, confidentiality and protection of your Personal Data. The measures are being in place in accordance with the PDPA and any other applicable laws and regulations.

5.2. As the protection of your Personal Data is our priority, we will review and update our security measures from time to time to ensure that your Personal Data is secured and safeguarded. In the event of any breach or attempted breach of security, we shall ensure our response to the same shall be acted upon promptly and accordingly.

6. Retention of Your Personal Data

6.1. Any of your Personal Data provided to us shall be retained for such a period that we may deem necessary to fulfil the purposes stated in this Notice or otherwise in accordance with any applicable laws and regulations.

6.2. We may, where applicable, retain your Personal Data for the purposes of:

• 6.2.1. legal proceedings and/or to comply with the legal process;
• 6.2.2. responding to any queries from you or on your behalf;
• 6.2.3. resolving any issues, complaints, disputes that may be raised or otherwise may be expected to be raised in relation to your Personal Data or our services; and

7.2. Please be noted that we may charge a nominal fee for a copy of your Personal Data as permitted by law. If we deny your request for access or correction, we will provide you with reasons for the same.

8. Withdrawal of Consent

8.1. You may withdraw your consent for the collection, use and/or disclosure of your Personal Data in our possession or under our control at any point in time by writing to us at the contact details provided below.

8.2. Please be noted that we may require a reasonable amount of time to process your request for withdrawal of consent and such withdrawal may affect the extent of our services provided to you.

9. Changes to the Notice

9.1. We may from time to time amend this Notice at our sole discretion and the amended version of the Notice shall be made available to you on our website or via e-mail.

9.2. The amended version of the Notice shall supersede all previous versions and shall be effective immediately upon being published on our website or being notified to you via e-mail.
